Can a 23 year old rent a car in NYS?

If its just for a day trip, and they'll be returning it the next day. Assuming they have good credit and a clean driving record? Also, is it possible to return the car to a non-airport rental location very late, like past 10 pm? Are they only open for car returns during normal business hours?
