A question about small business leeching of bigger ones?

i have recently joined a company thats advertising/marketing seems to be based on giving people the impression our company is infact the larger company that is reconised world wide i am concerned that this kind of practice may be illegal it is so similar in everyway the only difference is the name is slightly different could someone tell me about the laws regarding things like this if any or any possible trouble in the future i understand its hard for give to give to much details without causing a possible problem but there logos identical basically colors, banners, company name like for exmaple hmm the major company lets pretend its Pepsi well this one is Pepsistar even what the company does is identicle both dealing in the same market for example pepsi again pepsi star would also be a coke like drink i would just like to add its not pepsi btw and i made up pepsistar as examples the 2 companys have no conection to each other except the smaller one i feel is copying

It depends on the exact situation so to actually answer you I would need more information. If your company is using copyrighted information and are actually stating that they are a different company other than themselves then they are giving false information and representing themselves under false pretenses. There are situations that it is okay to do something similar to this. An example where this would be okay, if you were working for a credit card merchant and selling their products then you can use their name because you are working directly with the company. If the merchant was actually working with a larger company such as Bank of America, they can say they are affiliated and work through Bank of America, however they are not allowed to state that they are Bank of America because the contracts would be done through the actual company and not Bank of America. It is tricky to really answer because there are a lot of different variables and circumstances that can change the scenario. If you think it seems illegal then get yourself out of the situation, there is no point in you getting in trouble.

Illegality is hard to qualify without knowing exactly how your company is misrepresenting itself. However, when the larger company learns about this activity, there will likely be repercussions.

Well 'larger company that it is' is subjective. When it comes to marketing, there is a fine line. It's hard to answer your questions without knowing the company and what it's actually doing.
