What are my loan rights in Louisiana?
Husband has a loan out.. he's in Iraq. A woman showed up at my home demanding a payment. This is not her first time coming to my home now that she knows he's gone. I am not a co-owner or co-borrower on this application as I never signed anything. There is collateral for the small loan. A few TV's and such is what she rattled off. The pay off from what I'm told is around $200 dollars. After this woman almost pushing her way in to my home, and me telling her I'm not sure when I will in fact speak to my Husband she says, "Well, is the collateral here." My reply.. "Not that I know of". She says "Well, If I get the Sheriff's department out here to check you mean they won't find anything on this list". I'm not sure of what is on the list as I didn't go with him NOR consult with him when he initially took out the loan. She gave me until the end of the business day to talk to him and contact her back about a payment on the account. I was under the impression that she couldn't even discuss it with me as I'm not on the account- and he is not here. Yet, she's showing up at my home threatening me in front of my children. What are the laws in Louisiana regarding this small type of loan? And, what are my options being a spouse? Any help would be appreciated. BTW.. We are not Military.

It sounds as if he took a loan out with a finance company and used household goods as collateral. So the loan is secured, then they can take the items that he used as collateral to satisfy the loan. You should try and find the contract that was signed, it will detail the procedure. Louisiana is a community property state, so you will be liable for the loan also. Also call your State Attorney Generals Office, Consumer Division and ask them, they will tell you what she can do.

I believe that Louisiana is a community property state which means you would be equally responsible. You don't let the woman into your home unless she actually returns with a sheriff. Why isn't your husband paying this loan? You may want to check with the base legal office for assistance.

next time call the police, she is just strong arming you don't let her get away with it, the sheriff can't do a thing unless a judge tells him to
