Look up Residential Tenancies Act 2006 or Toronto/Ontario Tenant Law the laws are a guideline for both tenant/landlord.

First, make sure you have on hand the copy of the contract or rent lease papers. Go to him and show the papers where it states that the rent is due on a specific date each month. Now, before you jump to conclusions, you must verify with him the reason for not paying. Some times there may be a medical problem or maybe his pay from his job did not come through and was held back. First verify this. He may or may not have a legitamite excuse which 80% of the time happens. Then give him a warning, such as, if he doesn't come up with the rent money in 15 days (just to give him time to get it together) then tell him directly he'll have to move. Defults in paying rent is enough base for you to tell him to move out. He may thing that the month in advance that was paid or the holding money will be used to cover part of the rent owed. This is wrong. If a person payed first month and an advance which is a total of 2 months rent together, the advance you hold so if any damages to the place are present you can repair with that money. Before you tell him to move, make up a document stating that on such and such a date and time you talked to him and since no money for rent past due was given, you proceed with making him move, then sign it and hand him a copy. Supposidly you are to give him 3 months advance notice, this is another factor. But since he owes 2 months and has been living "free", then only one month is left to go for him. Talk to your lawyer, if you have one and make your documents legal. What is worse is if that you included in the rent any utilities, then they can be cut off as another strategie. You tell him that you have light and water to be paid and if you do not have all the money, it will be cut off by any of the companies providing the utilities. I live in Puerto Rico and I was recently at the Water Authority to pay my bill and there was a man who rents apartments and the water is included in the rent. What happened was that he water bill went sky high and as he was explaining to the person at the water company, he also said that he had a person who owed back rent. The water company told him several options: 1: have that person pay up or move out. 2: Have the water cut off at that persons apartment ASAP. 3: Or, make that person pay within 24 hours. Where you live, things maybe different but it is your place and utilities in the game that are being effected. Now the ball is in your court.
