I Have a charge off on my credit report and now the store is calling and saying they will garnish my wages?

Some years ago something was bought in my name at a appliance store, it was never fully paid off. It has been charged off of my report but I am now some years later receiving calls from this store telling me that I have a judgment against me(I was never served papers) and they are going to garnish my wages. Can they do this? What can I do. And no this is not a bank it is some appliance store in North Carolina.

They can't garnish your wages, they don't have the authority to do that. Even a bank can't do that, only the federal government can. They are just trying to use scare tactics form sleazy collections department. You do need to speak to a credit counselor though about getting fraudaluent activity removed from your report though, so it doesnt affect your future credit. Best of luck!

Get a copy of the judgement. If they have one, that means they sued you and it sounds as if you did not show up. I would try and work a payment plan, after seeing the judgement, employers don't really like employees that have their wages garnished - it shows they are not responsible. Good luck to you. Any one can have your wages garnished, as long as they sued you, and won.

A family member has had to deal with identity theft and with all kinds of products/credit cards. He had to hire a lawyer to go to court when one store tried to sue him. While he paid over $500 for the lawyer to do his stuff, the court event only lasted 10 minutes when the judge ruled it was indeed identity theft. The lawyer advised my family member to send a copy of the verdict to all 3 major credit bureaus to remove said item from his credit report. If you have such proof you do not need to get a credit counselor but can do so yourself. Unless the store went to court and won, there is no way they can garnish your wages. My advice is to do the same my family member did and hire a lawyer to find out if such a case or cases exist and get this straightened out. In my family member's case - he had to sort out a mortgage loan identity theft as well and had to get a lawyer since the mortgage company also tried to garnish his wages. Had he not gotten a lawyer he probably would have been garnished. Good luck.

This sounds like a Collection Agency violating the law. If it's charged off than the debt must've been sold to a collection agency. Do not deal with them over the phone. Tell them that you want a copy of the alleged judgment so you can satisfy it. I assure you they don't have crap. Some years ago? How long? Find out what the statue of limitaions is in your state.

Im not sure who told you that you have to be served. This is a civil matter not criminal. Most states just send you a summons to appear in court. If you dont appear they dont send you another letter saying you missed, they simply issue a default judgment against you. Can they garnish your wages? Depends on the state. They may or may not be able to proceed with enforcing a judgment if you have a solid job and income. Check with the courts and see if you have a judgment
