Question

what's the best solution for this?

it happened about a couple months ago. I was driving around.. 7 am in the morning and stoped at a RIGHT changing lane (Washington Street), preparing myself for a right turn onto another street (Maple Street). Well, as i was waiting, the turning arrow finally turned green and i proceeded onto Maple Street . As i was turning , a lady, at the opposite lane of Washington Street were blinded by the sunlight, went forward and crashed into my car. now, with the concern of any human, i parked my limping car next to a sidewalk and got out, examined myself for my body injury and then proceed onto seeing if the other person were ok. fortunately, no one were hurt, so we both done the next legal step: called the cop (but they were pretty much busy eating donuts or something) and exchanged information. in the process of exchanging, she bluntly stated that she were blinded by the light and wasn't able to see anything in front of her. I told her that i was ok, and that she should sit down since she were still shooken up by the whole odeal of mishaps. i documented in pen (times two) in had happened and what she had said out loud. Afterward, we both agreed into signing the paper in order to make it a legal document. Anyways, as of today, i recieved a phone called from my attorney stating that i "Forced" her into signing the paper, and that she felt threaten by me somehow. Thus, we'll be meeting up in court to determin wether or not i done w/e it was that she claim i done to her. At this point, i really dono what's gonna happened nor how to prepare for this. My lawyer states that they'll handle everything, but i prefer to see to it that i have some saying in this just because I am the main center of attention. i believe she not sueing me nor over assaulting her in anyways, but rather to determine wether or not who fault it was when it came to the accident.

Yep, both of you signing that, doesn't make it legal. By your admission, she was shaken up - and anything she signed while under stress isn't legal. it's not a binding document. But I'm not sure why you're in court over that paper. Is she suing you, or pressing assault charges?

you have filed this with your insurance company, right?? if not, do so asap. your insurance will make a determination of who is at fault, that is there job. many times people will admit fault at the accident but the adjuster will determine they were not at fault based on the facts of the accident, damages, witness statements etc. they may determine that she signed this paper under duress; the fact that you have an attorney makes me believe you are claiming injuries to her? at this point, do what your lawyer says. if he says shut up, shut up. let him do his job

Sounds like your attorney is just out for some cash. Why aren't you letting your insurance company take care of this claim for you. That is what you already pay them to do. Have you reported the accident to your insurance company? If not, call them ASAP. And, if you have call your claim rep for help. Not sure why your attorney is involved.
