Some Tenant Problems... what to do?

Probably going to be long-sorry. I have a tenant and his g/f that moved into one of our rental properties. The girl is very nice, always courteous to my husband and myself(we are the property managers, not the owners), then there is a matter of the b/f. Within a week of moving in, the girl informed us of 2-3 problems that we didn't know about. I scheduled a plumber to come fix the issues(they were a concern but not emergent) and called the girl to give her a date and time, and she agreed. That same morning at 3am, the b/f is calling my phone, cussing and complaining about the problems. The next morning, i called the girl(she is actually the only one in the house that qualifies income-wise for the property, and is the first person on the lease) and I explained to her that I cannot have him calling me at 3am for repairs that I cannot make at that time. I told her we accept calls from 7am-9pm for NON-EMERGENT calls. She agreed and said she would speak to the b/f, which she did and all was good..until March. He called me saying he wanted my residential address(i live very close but she doesn't know this), I gave him the PO Box that we use, and he was upset, screaming and going on and on that he wanted a REAL PHYSICAL ADDRESS. I apologized and told him that if he had a problem , i could give him the owners number and he could discuss it with them, to which he declined(he said he didn't want me picking up his rent on the first, he wanted to mail it, which is strictly against our policy since we change air/heat filters monthly, so why not do everything on the 1st anyway?). NOW, there has been another issue this month. We have a pest control contract on the house several times I have went over and escorted the exterminator, introduced him to the exterminator etc. I explained that I am pregnant and will no longer be able to escort the exterminator around(i cannot be around the chemicals currently). He agreed, and all was well, until today. The exterminator set up an appointment with me, I attempted to call him but got no answer. The exterminator went to the property and he refused to let him enter, saying that I didn't give him proper notice, so he didn't have to let him in. After I found this out, I called the other number that i have listed for them, which is the tenants cell phone. She informed me that he took her keys away, and will not allow her back to the property, she also warned me that he is very nasty, and will cause tons of problems for me, and that i will always require a witness to be around when i speak to him, because he will lie about things in a heartbeat. The girl explained that she wants to move back in, but cannot unless he is gone, and she also informed me that he does not qualify(income-wise) for the property. Tomorrow we have ANOTHER appointment with the exterminator to go there, what should I do? so far we have not had a problem with the rent being paid... I asked the girl if the guy was going to be able to pay the rent, she said she wasn't sure.(this is the first month that the girl is kicked out of the house)

UNOFFICIALLY: Since she wants to move back in to the unit, you can replace a key for her then give her permission to change the lock. Let her kick her b/f out, NOT YOU. Make sure you got a spare key of the new lock. OFFICIALLY AND LAWFULLY: Give them both a 30 or 60 day notice to move according to your state's law. Evict the guy if he still there after the notice expired. In the mean time, you still need to give him 24 hr notice before entering the unit. You can post the notice on the door instead of calling.

I would get the police involved if he kicked hr out and she is the rent payer- have him evcited if he is not paying the rent himself.

i would go with the police, at least you would be safe since you are pregnant. and if she is not living there.. see if you could remove her from the lease and have him evicted for not qualifying.

1. Pest Control-As long as you have in writing that the tenants were made aware of who they are, what they were going to do, the date they come, and you would no longer going to be accompanying him-all you can do is keep attempting to service the residence, and accept no complaints in re: pests. 2. Residency-If he is over the age of 18 and living in the residence, he is required to be on the lease(in the state of CA at least) and therefore meet the qualifications to live there. And if she is not living there, pull her off the lease, then evict him-- the residence should be empty once she is removed from the lease. I would definitely get the police involved for the eviction for your safety and be sure to file the proper paperwork for the eviction. Hope things work out! Brandi

Wow. Bad situation. You can hold your tenants 'jointly' and 'severally' liable. Give this jack***, a 30 day notice to leave the premises on grounds of disturbing the peace/failure to allow quiet peace and enjoyment of the premises, and/or failure to allow legal tenant (girl) rightful access to the premises. You can evict him w/o naming her in the action. Don't know about your state, but in Ohio, there is law pertaining to harassment of employees/owners of the property. He is bordering on that. Check your state's LL/Tenant Law. Be careful dear, this guy sounds like he's wound tighter than a banjo string.

If he isn't on the lease he has no rights and is trespassing. Have the police remove him and have an injunction signed barring him from stepping on the property.

where is your husband? If he also doesn't have any balls, you need to hire someone that does. Get these people out. Send someone with balls over there to shake him up. EVICT THEM.
