Medical bill question: Do I have to pay for it?
My wife took a laboratory test at a local clinic. She was told by the clinic that they accepted our insurance and that she will only pay a portion of the bill. A few weeks pass and we got the bill for 100% of the cost. The clinic said that the medical provider doesn't want to cover the bill since the test was done without the referral from the physician. We tried to get the physician to issue a referral after the test but they refuse and told us that we are not responsible for the bill since it was unauthorized. The clinic is now sending us a new bill and it increased since we have been trying to figure out what to do. Is there a law or rule that I have to pay for all of the bill if the clinic made the mistake to assume that the medical provider will cover some of the expenses when it doesnt? Do I need to pay for it or am I protected by some law? Thanks.

You owe the bill. Most likely, when she went for the test, when she signed a paper that stated financial responsibility regardless of insurance coverage, it put YOU on the hook. You aren't going to win this one. Unless you can convince the insurance company to pick up part of the tab if not all, you are going to have to pay this one.

The medical provider did not assume your insurance company would cover anything---they only told you that they accept your insurance company. It isn't the clinics responsibility to know whether or not you need a referral, or any other details about your coverage. That part is your responsibility. The clinic performed the test you requested, and you got what you asked for so why would you think you shouldn't have to pay for it? You should pay your bill before it ends up in collections, and continue your dispute with the insurance company.
