Landlord Tennant Problems? What are my rights?
I live in Colorado.... and here is my story..... Hello! So my oven has been broke since Sunday. Completly not able to cook anything.. won't even warm up or the burners don't work. I called the landlords on Monday aand let them know, but they didn't answer the phone so I left a voice mail, but I was at work and I seen the missed call. I tried to call them back but they were closed. So I tried the next day. She told me I can have someone come out and look at it today. I am very busy today, it's my day off and I have so many things planned but it is very important to me to get my oven fixed first. I called to maybe get a time frame, now they are telling me that they won't be able to get anyone out her until Friday. I have a daughter, and I only have eight dollars to my name right now until I get paid on Feb 5th. ((Thats also the day that I pay my rent)) I have a daughter to feed. I just went and got food from Walmart on Sunday... If I would have known my oven would break I would not have bought all food that I cook in the damn oven. I have eight dollars to my name... my landlords think its a joke or something. They want me to wait til Friday... What do I do legally?! My lease says they have to fix and pipes, electrical, fridge, oven. I am just young and I don't know what my options are now. I do not have a microwave either. We were having problems with the electrical and messed up the microwave.. LOL Please don't write me saying maybe the landlords don't have the money to fix it... I pay enough in rent and deposit for a couple ovens new or used LOL

Co. law gives the landlord 14 business days to fix appliances.

you have to give the landlord time to fix He told you to get someone to look at it. Now it is in your court. Get someome out to llok at it. It may be easily fixed. If not he has to fix or replace, Live is full of stuff like this. You told them about the oven on Tuesday and someone will be out on Friday..that is VERY fast

I called to maybe get a time frame, now they are telling me that they won't be able to get anyone out her until Friday.... --unless you meant to say, that you had previously arranged errands to do........ you could have postponed the other errands or YOU can also have a friend wait in your unit and allow the maintenance people to come in. What did you want the LL to do?

If the entire stove/oven doesn't work the first thing I would tell my tenant is to check the circuit breaker. It's odd for both the oven and burners to break at the same time. Check your circuit breakers. If an appintment was scheduled for Tuesday who cancled it? You don't have to be present when things like that are repaired. It's also possible the delay in service is due to the repair company and not your landlord. You need to talk to your landlord adult to adult. Don't get upset with him as that won't help. realtor.sailor

well, if they said they could come out today, you better go w/it or wait until the next time they can come out. they have to fix whatever is broke but only in a reasonable amount of time.

Look up Colorado state law to determine the time frame that your landlord has to fix the oven. If the landlord is not violating the time-frame, there is nothing you can do. If they are, then I would start by suggesting that they simply go to a home improvement store, buy a new range, and pay for same day delivery. Installation is easy because they just set in place and plug in. (assuming its electric). If they do violate the law for the time frame to get it fixed, you may have the option to break your lease and move out. You would need to contest in court that your landlord did not meet their legal obligations within the lease, and you could move out without penalty. Whatever you do, don't pay for the repairs yourself or withhold rent. Only a few states allow you to withhold rent for repairs, and the ones that do allow it require you to go to court over the issue first. In those few states, the court may order your rent deposited into an escrow account where the landlord can get it when they prove the repairs are complete. In the short term. I suggest you knock on your neighbor's door, introduce yourself, explain the situation, and ask if you can boil some water for Mac and Cheese. You could also use a camp stove if you have one. Ask your landlord if they have one you can borrow. Just don't use it inside because the carbon monoxide fumes will kill you (literally).

Well, it sounds like the landlord is making reasonable attempts to cure the issue, so there is probably nothing you can do to "force" the landlord to help you out. However, you might want to call and ask the landlord if, as a favor, they could lend you a microwave or a hot plate until the repairs can be completed. If you are a good tenant, most landlords will make all kinds of effort to do little things to help in such situations. Especially if you appeal to them in a nice way. Good luck.
