Question
Can I patent a gadget from a TV show?
I have seen a gadget on a TV show which I would like to manufacture and sell through retail outlets (after obtaining an official license from the TV company). Can I apply for patent protection on the gadget or is it deemed as publicly disclosed due to it's appearance on the TV? Would the TV company copyright on the design be protection enough?

In the U.S., one of the requirements for receiving a patent on something is that you have to have been the one to invent it. If you saw it on King of Queens, then you didn't invent it. Therefore, you can't get a patent on it. Also, the public disclosure starts a 1 year count down clock, the expiration of which would also prevent the inventor from getting a patent.
