Trademarking a shape used on a product?

For people familiar with trademark law: I have a guitar I'm building with a distinctive shape for the headstock. From what I've read online about trademarks, you have to be actively selling the product to claim the right to register the shape as a trademark.. Is there no way that I can ensure that nobody can copy the shape, if I haven't put the guitar 'in to production' yet? I'd rather have this protection in place before everyone sees it..

First, you probably would not use a trademark, but instead it should be what in the U.S. is called a DESIGN PATENT. Use requirements usually come after the filing. If you drop me a line on where you are located I could give you a reference on a nearby Intellectual Property attorney in your area.
