Question

can solicitors suspend your bank account?

On behalf of the local city council their solicitors have threatened to suspend a friends bank account for not paying council tax. Are they actually allowed to do that and how do they know what your details are etc? What process do they go through to get that information if so?

Its not actually the solicitor who suspends the account the Solicitor writes a request to the bank its up to the bank manager to decide if the request is justified, If not the solicitor will need to get a warrent from a magistrate. The solicitor can easily find out who you bank with, all he needs to do is a credit search a record of your account history is on there. I know of someone who had their bank account frozen because they owed council tax but it was frozen with a warrent.

In the US, they can do that with a court order. I assume it is a similar proceedure in the UK. They can obtain that information from various non-public reports (not sure of the titles) and databases.

They will probably know about the bank a/c from direct debit details. If not, they can find out from the Financial Services Authority/Inland Revenue. Council Tax is one of the few bills where they can do anything they want. Your friend should offer a payment plan

'fraid so...they get the information from your council tax account...it's called an attachment of earnings

Yes they can by court order and believe me it doesn't take them long to get one. They will then make an an attachment to earnings or benefits which means they get their money and you get to keep what is left. But then if you one isn't paying council tax as they should can you blame them.
