Can the department of labor force my previous employer to pay my back wages?

I worked as a sales associate at a gym and i'm trying to collect the commission of one sale and pro-rated base pay that has been owed to me since I quit late September. I've corresponded with them through email so that I have it all in writing and the owner of the gym has given me excuses as to why he is not going to pay me. If it gets to the point where I need to contact the department of labor (which is looking to be likely) is it a guarantee that they can help me get what is owed? Has anyone had a similar problem? In response to Peggo...would my dated letter of resignation be sufficient? That way it proves I was employed with them up until that date.

I would try one more email. Tell the owner that you have attempted to resolve this peacefully and between the two of you, but you have still not been compensated. Tell him he has two weeks to either pay what is owed, or you are going to pursue this through the Department of Labor. I can't guarantee they can get you what is owed, but they can do alot more to him than you could. They may tell you to hire an attorney and take him to court. But they can tell you how to proceed. But I would give him one more opportunity to comply first.

yeah, also try the better business bureau. That is money you worked for and they have to pay you what is rightfully yours.

You have to have very good records that you have kept to prove it is Truly your money, if you do then; Yes they will assist you.

Contacting the department of labor doesn't guarantee that you get your money - they might not agree with your interpretation, and even if they do, that just gets you a piece of paper saying that the guy does owe you, not the actual cash in hand. But the state DOL is a good place to start.
