Renter problems in Illinois - he is not on lease?

I have a subtenant who I have had several problems with. He is not on the lease. We had a verbal agreement that he would live here for one year, ending in July 2008. He paid $800 a month to live here, all expenses included. In October of last year, he lost his job and didn't tell me until I asked for rent in November. He gave me his sob story, I felt bad for him, so I arranged where he could pay $200 a week for rent an additional $50 a week to pay back November rent. He has been fairly consistent with those payments, but bounced a check at the end of March. He is traveling on business and I have communicated with him by email that he needed to pay or get out by the end of April (as he hasn't paid any of April rent either). He said he'd be back this weekend to talk about it, and hasn't come. I want him out!!! What do I do? Can I pack his stuff and put in storage? I don't care about the money, I just want him to leave! Help?

You can't just pack up his stuff. He does not have to have a lease. You have to evict him just like anyone else. BTW, email is not legal communication. A judge will not accept it as legal notice.

He has as many rights as if he were on the lease. Believe it or not, it makes no difference, as you accepted rent from him. You need to serve him with 30 days notice to vacate. After that you can take him to small claims court for the balance owed. You know you got yourself into this fix as much as him, don't you watch Judge Maria, Judge Judy, Judge Mathis, etc. etc. etc.?

What do your state and local laws require? Is there any special wording in your lease that would force the tenant out - this would be unusual. Most likely you will have to go through the eviction process - do not just move your tenant out, you'll just create a legal problem for yourself.
