Question

Returned lease termination notice letter??

I was notified that my landlords want to move in the house I am currently living in. The date they have given me to be out by has changed several times. I have found a new place & sent off my 30 day notice for our month to month lease. I sent it to the address that was stated on the lease. I sent it certified mail & 10 days later I got it returned rendered undelieverable & unable to forward. I have tried to call but no one answers & there is no voice messaging system. I found their home address in the white pages & as of right now that is the only way I have to contact them. I have to say I have been very patient with this terrible landlord, not to mention the legal action I could bring with JAG. Right now I just want to get out. What should I do?? Thanks. I sent my notice 27 February, I got it back 8 March. I was planning to be out by 31 March. So, there will be no more rent involved!! I am just trying to cover myself from every angle possible =) I don't mail my rent. There is an account I am to deposit it into every month.

Wait to hear from them for your rent payment. That's a sure way to hear from them! At that time, you can give them notice, explain and show the proof that you attempted to give proper notice.

The best way is to send TWO copies of the letter, one certified and one regular. If only the certified one come back you can be assured the regular on was delivered. Send it to the same address you send the rent to. Give your thirty days notice and leave. Understand the landlord may try to keep your Security Deposit (it's not usually legal to use it to cover the last months rent) so have an independent person witness the condition of the property when it's empty (and use photos that each contain the front page of the local newspaper in it). The landlord must give a written accounting of the deposit within 30 days (be sure he has your new address) or he forfeits the right to keep any of it.
