Question

Breaking a Lease in Ohio?

I am moving to Illinois from Ohio. My lease ends 4/31/2008. The apartment manager says that I have to pay the last two months since I will be out in Mid February. Somone told me that the state of Ohio has a law where you do not pay anything if you break the lease due to a new job in another state. I checked with the apartment manager and she said that it is true only if it is a job transfer and not a new job. 1-Is this true? 2-How can I resolve this situation and avoid paying the last two months?

Frankly, I know of nothing in Ohio law which allows you to break a lease with no fees for a new job OR a job transfer. Generally, such statutes are written to apply ONLY to active members of the military who are required to move because of duty changes. The only way for you to resolve the situation is to pay the rents according to your lease.

While I do not have an OH or an Il broker's license, I do have one in AZ and this idea of "if you have to move, your lease can be easily cancelled just by paying the last 2 mo. smile-- it is also a tax write-off. if this is true i need to learn about it.

Too bad you didn't know not to ask the prick manager before? But I'm pretty sure that you can get out of the lease regardless. They can't hold you ransom for good cause. I could see if you were moving around the corner for a better apartment or better location. Get someone and sublet for 2 months. Then make sure they are out. If that's too much of a strain. Start moving in the middle of the night little by little. or did you tell them where you were moving too?! Read this: Read the part about the Job....... apartments ...
