The answer to the first and second are intertwined. When you register your company you automatically protect the name and can also do so for the trademark by putting it in the papers you file. Therefore you will have to search the records of your state and or the states where you intend to be to ascertain the fact that you are not imposing on any one else's "property". The example of craigslist or what ever one would protect the business, commerce or service process as well as any intellectual property you generate ie.. the way in which you manage or present information etc. That area is currently so convoluted that it is next to impossible to insulate yourself from lawsuits given the litigious society we live in and the fact that the protection process has given protection to the most simple processes. The example used is the way one can swing on a swing! ie.. if you swing from side to side that process has been given a copy right and you could get sued if you use it in a game that you introduce on TV etc! Seed capital and a good lawyer is a great asset to a startup.
