Lien Law in New York State?

A painter who worked on a house 63 days ago files a lien on the morning of the scheduled passing of title. Is the lien filed on time? I think the lien has to be filed within four months since this is a single family house. But is a lien holder allowed to file on the morning of the closing date? Does this mean that the seller cannot convey clear and marketable title, and if not, is there anything the seller can do to remove the lien?
