My wife is a doctor in PA ... how can she get out of her non-compete agreement?

We are in a small city in Pennsylvania where her 10 mile noncompete covers the whole city area. She just wants to start a small practice out of our home for friends and relatives while she raises our kids (we have another on the way), but her contract states she can get sued for $50K if she practices within 10 miles of her current office (our home is 5 miles from the office). Is there any way we can get out of this 2 year contract?

First call an attorney in your state since all state laws are different. Don't waste any time or money. Be sure that the lawyer you go with does have experience in a such a case as yours. Other then that all I can say is good luck and I hope that things work out for your family. And if someday your wife does want to work from home let me know.

Read the fine print. Probably not. She must open her practice 10 1/2 miles away......

Non-compete agreements do not usually hold up in court. Many tech companies have used them only to be ignored by the courts in the name of free commerce or competition. Open the practice and let the other office hire lawyers and sue you. You can have the other office pay your attorney's fees when you win.

Most not all of this kind of agreement are not worth the paper they area written on, NO one can stop you from making money in your license profession. But I would still contact a lawyer and pay a small fee to answer it for sure.
