Question
Trademark Question about Domain name?
Today i register on business name like trademark in this website (trademarkia). I check the domain name and .com and .net are taken. I saw mytrademark.net is legit business from 1997. So my question is what can i do ? Can i force people to give me the domain name (.com) and can i force the legit business from 1997 to change they name ?
p.s I have valid trademark from the USPTO. So what next ?
Thanks

A trademark does not provide you with legal rights to a specific domain. Since these businesses have owned their websites longer, you can purchase it from them. Trademark offers some legal protection, but not complete. Incorporation would provide you with more protection if these businesses are in the same type of industry. If they are in other industries like Apple - Apple Computers, Apple Music, Apple Printing - they are allowed to have the same name.

In domain ordering, the service comes on a first come, first served. You cannot in any means force someone to give you their domain, even if it's named for example cranberry.com but they sell power tools. The only thing you can do is to backorder a domain, which will place you in an auction at the end of that domain's registration period, or you can try on amiable terms to buy the domain name from the current owner.
